Terms of Use

The short version. Annual Calendar tells you what is happening in the watch world. We are not the organiser of the events we list, we do not sell tickets, and we cannot guarantee every detail is right — always check with the organiser before you travel. Be 18 or over, be decent, and the app is yours to use.

1. Who these terms are with

These terms are an agreement between you and Kaizen Technologies Ltd, a company registered in England and Wales under company number 09108099, whose registered office is at 4 Wagtail Court, 34 Pipit Drive, London SW15 3BF ("we", "us", "our").

They cover the Annual Calendar iPhone app and this website (together, "the service"). By downloading or using the service you accept these terms. If you do not accept them, please do not use the service.

2. Who can use it

You must be 18 or over to create an account. You may only hold one account, and you must give accurate information when you create it.

3. What the service is — and is not

Annual Calendar is a directory. We gather publicly available information about watch industry events and present it in one place, with a link out to the organiser.

4. Your account

You sign in with Apple or Google. Keep access to that account secure — anyone who can sign in as you can see and change your Annual Calendar profile and saved events. Tell us promptly at justin@justinhast.com if you think your account has been misused.

You can delete your account at any time; see our Privacy Policy for how, and for what we do with your data.

6. Content and intellectual property

The service, its design, its software and the way we compile and present our listings belong to us or our licensors, and are protected by copyright and other rights. We grant you a personal, non-exclusive, non-transferable, revocable licence to use the app on devices you own or control, for your own non-commercial use.

Brand names, logos, trade marks and event imagery belong to their respective owners. They appear here to identify events and exhibitors, not to suggest any endorsement or partnership.

If you are an organiser or rights holder and believe something we have published is wrong, misattributed or infringes your rights, email justin@justinhast.com with the detail and we will review it promptly and correct or remove it where appropriate.

7. Content you provide

You keep ownership of anything you upload, such as a profile photo. You grant us a licence to store, reproduce and display it for the sole purpose of operating the service for you. You confirm you have the right to upload what you upload. We may remove content that breaches these terms.

8. Availability and changes

We work to keep the service running, but we do not promise it will be uninterrupted or error-free. We may change, suspend or discontinue any part of it, and we may add or remove listings at any time. If we discontinue the service altogether we will give reasonable notice where we can.

9. Third-party links and services

The service links to organiser websites, social media and other third-party services, and uses Apple and Google for sign-in and Apple Maps for map views. We are not responsible for third-party sites or services, their content, or their handling of your data. Their own terms and privacy policies apply.

10. Disclaimers

The service is provided "as is". To the fullest extent the law allows, we exclude all implied warranties, including that listings are accurate, complete or fit for a particular purpose.

Nothing in these terms affects your statutory rights as a consumer under UK law, which cannot be excluded or limited.

11. Our liability

We do not exclude or limit our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be excluded.

The service is free and intended for personal use. If you use it for business purposes, we accept no liability for business losses.

12. Ending this agreement

You can stop using the service and delete your account at any time. We may suspend or terminate your access if you materially breach these terms, or if we are required to by law. Sections that by their nature should survive termination — intellectual property, disclaimers, liability and governing law — will continue to apply.

13. Changes to these terms

We may update these terms from time to time. We will change the date at the top of this page, and for significant changes we will give notice in the app or by email. Continuing to use the service after a change means you accept the updated terms.

14. Apple App Store terms

These terms are between you and us, not Apple, and Apple is not responsible for the app or its content. Apple has no obligation to provide maintenance or support for the app. If the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price, if any; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app. Apple is not responsible for addressing any claim by you or a third party relating to the app, including product liability, regulatory non-compliance or intellectual property claims. You confirm you are not located in a country subject to a US Government embargo or designated as terrorist-supporting, and are not on any US Government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

15. General

If any part of these terms is found unenforceable, the rest continues to apply. Our not enforcing a term is not a waiver of it. You may not transfer your rights under these terms; we may transfer ours if we sell or restructure our business, without reducing your rights. These terms are the entire agreement between us about the service.

16. Governing law

These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction. If you live in Scotland or Northern Ireland, you may also bring proceedings in your home courts.
